Terms and Conditions – YOME Collection

2. Applicability
These terms and conditions apply to all use of the website and to all agreements concluded through the YOME Collection webshop.
3. Use of the website
It is not permitted to use the website for unlawful purposes or in any manner that could disrupt the operation of the webshop.
4. Intellectual property
All content on this website, including texts, images, logos and product information, is the property of YOME Collection or is used with permission, and may not be used, copied or distributed without prior written consent.
5. The offer
YOME Collection sells vanity tables, dressing tables and related products. Obvious mistakes or errors in the offer are not binding on YOME Collection.
6. Formation of the agreement
The agreement is concluded at the moment the consumer places an order and receives a confirmation of that order by email.
7. Prices
All prices on the website are inclusive of VAT and exclusive of shipping costs, unless stated otherwise.
8. Payment
Payment must be made immediately using the payment methods offered within the webshop.
9. Delivery
Delivery takes place at the delivery address specified by the customer.
YOME Collection aims to deliver orders within the indicated time frame. The risk of damage to or loss of a product passes to the consumer at the moment of delivery, unless the law provides otherwise.
10. Right of withdrawal
The consumer has the right to withdraw from the agreement within 14 days without giving any reason.
The cooling-off period begins on the day after the consumer, or a third party designated by the consumer, has received the product.
After withdrawal, the consumer has a further 14 days to return the product.
The direct costs of returning the product are for the consumer's account, unless expressly agreed otherwise or in the case of an incorrect, damaged or defective product.
11. Return conditions
The product must, where reasonably possible, be returned unused, complete and in its original condition and packaging.
If the product has been used more than necessary to assess it, a reduction in value may apply.
12. Refund
A refund will be issued within 14 days after the consumer has notified the withdrawal. YOME Collection may wait to issue the refund until the product has been received, or until the consumer has demonstrated that the product has been returned, whichever is earlier.
13. Exclusion of the right of withdrawal
The right of withdrawal may be excluded for:
- products manufactured according to the consumer's specifications;
- products that are clearly personal in nature;
- products that, for reasons of hygiene, cannot be returned once the seal has been broken.
14. Conformity and warranty
YOME Collection's products comply with the agreement, the specifications stated in the offer and the reasonable requirements of soundness and usability.
15. Liability
YOME Collection is not liable for indirect damages, except in cases of intent or gross negligence, or to the extent that liability cannot be excluded by law.
To the extent permitted by law, liability is limited to the amount of the relevant order.
16. Misuse and fraud
YOME Collection reserves the right to refuse, suspend or cancel orders in the event of suspected fraud, misuse or unauthorised use of the webshop.
17. Complaints
Complaints can be submitted via support@yomecollection.com. We aim to respond substantively within 14 days.
18. Applicable law and disputes
These terms and conditions and all agreements between YOME Collection and the consumer are governed by Dutch law.
This choice of law does not deprive consumers residing in another EU Member State of the protection afforded to them by mandatory provisions of the law of their country of residence.
Disputes will be submitted to the competent Dutch court, unless mandatory law provides otherwise. Consumers residing in another EU Member State may also bring proceedings before the competent courts of their country of residence. Consumers may also submit a complaint via the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
